Lane splitting is legal in Cali, why would he be screwed?

Knowing lane splitting is legal and seeing it all the time, the driver should have:

1. Not crossed the double yellow line.
2. Checked his mirrors before attempting a lane change.
or
3. NOT CROSSED THE DOUBLE YELLOW LINE.

I'll have to go watch it again. His speed didn't seem unreasoanble to me.
